Lawyers Crusade Much Bigger Than Brookhaven
Chattanooga attorney Scott Bergthold travels the country writing ordinances for governments to regulate adult businesses out of business.

When the city of Brookhaven decided to rewrite its adult oriented business ordinance, interim city attorney Bill Riley brought in Chattanooga based attorney Scott Bergthold. As an attorney, Bergthold specializes in drafting adult oriented business ordinances and inevitably defending them in court. According to Bergthold’s website adultbusinesslaw.com his firm’s narrow focus is “on the drafting and defense of municipal adult business regulations.” His website also boasts a long list of government clients in 21 states along with several national municipal organizations.
Scott Bergthold graduated from Regent University in ’97. Regent, a Christian school founded by televangelist Pat Robertson, states its mission as “a center of Christian thought and action to provide excellent education through a Biblical perspective and global context equipping Christian leaders to change the world.” Bergthold took this mission as a call to action and after graduating became involved with the Christian based, socially conservative organization American Center for Law and Justice (also founded by Pat Robertson). He then became president of the Community Defense Council, a resource for Alliance Defending Freedom, another Christian legal organization based in Arizona and co-founded by evangelical leader Dr. James Dobson. The ADF’s website states their cause as “a servant ministry building an alliance to keep the door open for the spread of the Gospel by transforming the legal system and advocating for religious liberty, the sanctity of life, and marriage and family.”
Bergthold then opened his own law firm in Chattanooga Tennessee. He currently travels around the country writing ordinances for municipalities to regulate adult businesses. Municipalities pass these ordinances into law, then hire Bergthold to represent them in court – and the city of Brookhaven is no exception.
Bergthold helped write the city of Brookhaven’s adult/sexually oriented business ordinance, which the Pink Pony has filed suit against, stating that the ordinance is unconstitutional. The city of Brookhaven and interim city attorney Riley have hired Bergthold to advise the city in its dealings with the Pink Pony. Since Bergthold is not licensed to practice law in Georgia, he is serving the city as a legal consultant.
